ZimCupid Terms & Conditions

Welcome to ZimCupid. By accessing or using the Platform, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with these terms, please do not use the Platform.

1. Eligibility and Age Requirement

By using ZimCupid, you confirm that:

1. You are at least 18 years old or the legal age of majority in your jurisdiction.
2. You are legally permitted to use dating and social networking services under applicable laws.
3. Any information you provide during registration, including your date of birth, is accurate and truthful.
4. Users under the age of 18 are strictly prohibited from registering, accessing, or using the Platform.
5. You will not allow any person under the age of 18 to access or use your account.

As part of the registration process, users may be required to:

• Enter their date of birth; and/or
• Confirm via checkbox that they are 18 years of age or older.

ZimCupid reserves the right to suspend or permanently terminate accounts suspected of belonging to individuals under 18 years old and may take appropriate action where required by law.

2. Account Responsibility

You are responsible for maintaining the confidentiality and security of your login credentials and account activity.

By using the Platform, you agree that you will not:

1. Share your account with another person;
2. Impersonate another person or create a false identity;
3. Misrepresent your age, identity, relationship status, or intentions;
4. Use the Platform for fraudulent, unlawful, deceptive, or misleading purposes;
5. Create multiple accounts for the purpose of circumventing Platform restrictions or enforcement actions.

ZimCupid is not liable for unauthorized access to or use of your account resulting from your failure to maintain account security.

3. User Content, Photos, Videos & Consent

By uploading, posting, or sharing any photos, videos, profile information, comments, messages, or other content on ZimCupid, you grant ZimCupid a non-exclusive, worldwide, royalty-free license to host, display, stream, reproduce, publish, and distribute such content for purposes related to operating, maintaining, improving, marketing, and promoting the Platform, subject to our Privacy Policy and applicable law.

You acknowledge and agree that:

1. Other users may view your profile, photos, videos, and uploaded content;
2. Users may contact you through the Platform;
3. Uploaded photos and videos may be viewed, streamed, shared, or downloaded by other users where Platform functionality allows;
4. You voluntarily consent to your content being displayed on the Platform;
5. You are solely responsible for the content you upload;
6. You confirm that you own or have the necessary rights and permissions to upload and share such content;
7. You must not upload content depicting another person without having the appropriate permission or legal right to do so.

ZimCupid reserves the right to remove, restrict, or disable access to any content that violates these Terms & Conditions.

4. Non-Nudity, Sexual Content & Explicit Material Policy

ZimCupid is intended for adult dating, social networking, friendship, and relationship purposes. Nudity and sexually explicit content are strictly prohibited.

You agree that you will not upload, post, send, transmit, display, or otherwise share content that:

1. Contains full or partial nudity intended to be sexually suggestive or explicit;
2. Displays exposed genitals, breasts/nipples, or buttocks in a sexually explicit or provocative manner;
3. Contains sexually explicit photographs, videos, GIFs, illustrations, or other visual material;
4. Depicts or promotes sexual acts or explicit sexual activity;
5. Contains pornography or pornographic material;
6. Is created or shared for the purpose of sexual solicitation or commercial sexual services;
7. Promotes prostitution, escort services, sexual exploitation, or trafficking;
8. Sexualizes or exploits minors in any manner;
9. Contains sexually explicit messages or requests directed at other users;
10. Attempts to circumvent ZimCupid's content moderation or safety systems.

This policy applies to profile photos, cover photos, albums, videos, messages, comments, usernames, bios, and any other content submitted through the Platform.

Enforcement

ZimCupid may, at its sole discretion and subject to applicable law:

• Remove prohibited content;
• Restrict or disable access to content;
• Issue warnings;
• Temporarily suspend accounts;
• Permanently terminate accounts;
• Restrict users from creating new accounts;
• Report illegal or potentially criminal activity to appropriate authorities where required or permitted by law.

Users should report suspected violations through the appropriate reporting tools or by contacting ZimCupid support.

ZimCupid does not guarantee that every violation will be identified or removed immediately. Users are responsible for exercising appropriate caution when interacting with other users.

5. User Conduct

By using the Platform, you agree to:

1. Interact respectfully with other users;
2. Comply with all applicable laws and regulations;
3. Avoid harassment, abuse, discrimination, threats, intimidation, stalking, or harmful behavior;
4. Respect the privacy, boundaries, and consent of other users;
5. Not request or distribute another user's private or sensitive information without permission;
6. Not use bots, automated systems, scraping tools, or other methods that disrupt or interfere with Platform operations;
7. Not use ZimCupid to conduct scams, fraud, phishing, money requests, or other deceptive activities;
8. Not use the Platform for unlawful commercial activities or solicitation.

Any misuse of the Platform may result in suspension or permanent termination of your account.

6. Payments, Subscriptions & Non-Refundable Payment Policy

By purchasing any subscription, premium feature, virtual item, upgrade, or other paid service on ZimCupid, you acknowledge and agree that:

1. All purchases are final and non-refundable, except where a refund is expressly required by applicable law or expressly authorized by ZimCupid.
2. Once a paid service, subscription, premium feature, or other digital service has been purchased or activated, you generally will not be entitled to a refund for unused time, unused features, dissatisfaction, or failure to use the service.
3. ZimCupid does not guarantee that you will find matches, friendships, relationships, dates, communications, or any particular outcome through use of the Platform.
4. Individual results and experiences may vary based on personal preferences, compatibility, location, activity, availability, and interactions with other users.
5. Dissatisfaction with matches, lack of responses, incompatibility with users, rejection, inability to establish a relationship, or failure to find desired connections does not qualify for a refund.
6. Users are responsible for reviewing subscription details, pricing, renewal terms, and billing information before completing a purchase.
7. Where subscriptions automatically renew, users are responsible for cancelling their subscription before the applicable renewal date if they do not wish to be charged for the next billing period.
8. Cancellation of a subscription generally stops future renewals but does not automatically create an entitlement to a refund for the current or previously purchased billing period.
9. Promotional offers, discounts, credits, bonuses, or complimentary services may be subject to additional conditions and may be non-refundable and non-transferable.
10. ZimCupid may, at its discretion, provide refunds or credits in exceptional circumstances. Any such refund or credit does not create an obligation to provide refunds in similar circumstances in the future.
11. Chargebacks or fraudulent payment disputes for validly delivered services may result in immediate suspension or permanent termination of your account and may be investigated or disputed by ZimCupid.
12. By completing a purchase, you acknowledge these payment terms and authorize ZimCupid or its applicable payment processor to process the applicable subscription or service fees.

Important Refund Limitation

Nothing in these Terms & Conditions is intended to exclude or limit any refund, cancellation, withdrawal, or other consumer rights that cannot legally be excluded under applicable law.

7. Privacy

Please review our Privacy Policy to understand how we collect, process, store, use, and protect your personal information and uploaded content.

By using ZimCupid, you acknowledge that your use of the Platform is also subject to the Privacy Policy.

8. Termination of Use

ZimCupid reserves the right to suspend, restrict, or terminate your access to the Platform at any time, subject to applicable law, if you:

• Violate these Terms & Conditions;
• Post prohibited, harmful, abusive, fraudulent, sexually explicit, or illegal content;
• Provide false or misleading information;
• Harass, threaten, scam, exploit, or harm another user;
• Attempt to exploit, damage, disrupt, or interfere with the Platform;
• Circumvent account restrictions or enforcement measures.

Termination or suspension of an account due to a violation of these Terms does not automatically entitle the user to a refund of previously purchased services, except where required by applicable law.

9. Limitation of Liability

ZimCupid is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, ZimCupid is not responsible for:

1. User-generated content;
2. The conduct, actions, statements, or omissions of other users;
3. Interactions, communications, meetings, dates, or relationships between users;
4. Unauthorized sharing, downloading, copying, or misuse of uploaded content by third parties or other users;
5. Service interruptions, technical problems, errors, outages, or downtime;
6. Loss or damage arising from reliance on information provided by another user;
7. Any direct, indirect, incidental, special, consequential, or similar damages arising from use of the Platform, to the extent permitted by law;
8. Failure to find matches, friendships, relationships, dates, or desired outcomes.

Users access and use the Platform at their own risk and are responsible for exercising reasonable judgment and caution when interacting with other users.

10. Modifications

ZimCupid reserves the right to update, modify, or replace these Terms & Conditions at any time.

Where appropriate, material changes may be communicated through the Platform or other reasonable means.

Continued use of the Platform after updated Terms & Conditions become effective constitutes acceptance of the revised Terms.
